GENERAL TERMS AND CONDITIONS OF SALE

Purpose:

These general terms and conditions of sale are concluded between: Fil de Légende (hereinafter the seller), a SARL with a capital of 10,000 euros, registered with the Nanterre Trade and Companies Register under no. 788 813 095, domiciled at 60 rue de Longchamp – 92200 Neuilly-sur-Seine, and any natural person (the Client) visiting and/or wishing to make a purchase via the website www.fil-de-legende.com (hereinafter the "website"). These conditions aim to define the terms of distance selling between Fil de Légende and the Client, from order to payment and delivery. They regulate all steps necessary for placing an order and ensure the follow-up of this order between the contracting parties. The order implies irrevocable, full and complete acceptance of the general terms and conditions of sale, which you acknowledge having read before placing the order. As the general conditions may be subject to modifications at any time, the applicable conditions are those in force on the website www.fil-de-legende.com on the date the Client places the order.

The Client declares:

- to have the legal capacity to enter into this contract, enabling them to be bound by the general terms and conditions of sale

- that the purchase of the product on the website is not directly related to their professional activity and is limited to strictly personal use

Products

The products offered for sale by Fil de Légende are those available on the website www.fil-de-legende.com, on the day the Client consults the site.

Fil de Légende undertakes to accurately present and describe the products in order to "enable the consumer to know the essential characteristics of the good" in accordance with Article L.111-1 of the Consumer Code. However, if errors or omissions were to occur in this presentation, Fil de Légende cannot be held liable. The photographs and texts illustrating the products are for indicative purposes only and have no contractual value.

Prices

All prices indicated on the website are in euros, including all taxes (20% VAT), excluding shipping costs which remain the responsibility of the Client.

Prices include the VAT applicable on the day of your order. Any change in the VAT rate will automatically be reflected in the price of the products without the Client being informed in advance. Fil de Légende reserves the right to modify its prices at any time. Products will be invoiced based on the rates in effect at the time the order is registered.

Order

Any new customer must first create a customer account by entering their contact details (surname, first name, postal address, email address, telephone number) and a password before placing an order.

Any order implies full and complete acceptance of the general terms and conditions of sale. In order to allow the Client to review their order before definitively validating it and to correct any errors, Fil de Légende has created validation and acceptance screens. The order will only be definitively registered upon the final validation of the order payment screen (by credit card). From the last acceptance click, the order is considered irrevocable and equivalent to the handwritten signature referred to in Article 1341 of the Civil Code. An email will be sent to the user upon registration of the order. This email confirms that the order has been taken into account by Fil de Légende, but not that the ordered product is available.

Availability

Ready-to-wear clothing and accessories in stock are marked as such on the website.

Tailor-made or customizable garments are made to order within a timeframe defined beforehand with the client.

 

Payment

The Client guarantees to Fil de Légende that they have the necessary authorizations to make the payment.

Payment is made online by credit card via PayPal. Accepted cards are Carte Bleue, Visa, Mastercard.

Payment can also be made by transfer to the Fil de Légende account.

Fil de Légende reserves the right to suspend or cancel any order and/or delivery, regardless of its nature and stage of execution, in the event of non-payment or partial payment of any sum due by the user, in the event of an ongoing payment dispute, in the event of a payment incident, or in the event of fraud or attempted fraud related to the use of the website www.fil-de-legende.com.

Fil de Légende reserves the right to request supporting documents from the client, before validating an order, which must be sent by email to the following address: karine.couture@fil-de-legende.com. The order will only be validated after receipt and verification of the sent items. Failing receipt within 15 days of placing the order, the latter will be considered automatically cancelled.

Fil de Légende retains full ownership of the products sold until full payment of the entire price, including principal, charges, taxes and compulsory contributions.

Shipping costs, conditions and delivery times

Delivery method

Products are delivered to the address indicated by the Client on the order form. The Client must verify the completeness and accuracy of the information they provide to Fil de Légende. Fil de Légende cannot be held responsible for any data entry errors and their consequences in terms of delay or delivery error. In this context, all costs incurred for reshipping the order will be entirely borne by the Client.

Delivery rates

Delivery rates are as follows (for shipments within Metropolitan France):
Up to 0.5 kg: €6.5
Up to 1kg: €8
Up to 2kg: €13
Up to 3 kg: Price to be defined based on package weight and size

Delivery times

We send your packages via Colissimo France and Colissimo International for Europe, the United States, and Asia.

Clothing and accessories in stock:
France: 3 working days (Monday to Friday)
Europe: 4 working days (Monday to Friday)
Rest of the world: 5 to 7 working days (Monday to Friday)

Accessories and clothing made to order:
Allow an average of 3 to 6 weeks, which can extend up to 3 months or more, depending on what has been defined with the client.

In the event of a delay, Fil de Légende will contact you by phone or email. Fil de Légende cannot be held responsible for delivery delays attributable to the Client, a force majeure event, or a third party, particularly the carrier in case of product loss or strikes. In such a case, no compensation claim of any kind can be made by the Client to Fil de Légende.

For France, the package is left without signature in the Client's mailbox. If the mailbox cannot contain the package, a delivery notice will be left in the mailbox. It indicates the details of the post office where the package can be picked up. The Client then has 15 consecutive days to collect it. After this period, the package will be returned to us.

For international deliveries, the package will be handed over to the Client in person against a signature. In case of absence, a delivery notice will be left in your mailbox, and you will have 15 consecutive days to pick it up at the post office mentioned on the slip.

Products are packaged according to current transport standards to ensure optimal protection during delivery.

Goods always travel at your own risk. You must check the good condition of the merchandise upon arrival of the package in the presence of the delivery person and report any anomaly on the delivery slip to the carrier and to Fil de Légende. In the event that the carrier does not allow the client to check the packaging and products, the Client must imperatively note this on the delivery slip. You have 2 working days to make any reservations with the carrier in case of missing or damaged items. If such remarks have not been noted on the delivery slip presented to the client by the carrier, the product is deemed accepted by the user and cannot be subject to any dispute concerning its delivery.

Returns and exchanges

In accordance with Article L.121-20 of the Consumer Code, you have a period of 14 days from the date of delivery of your order to exercise your right of withdrawal for clothing and accessories in stock, return products that do not suit you, and request a refund without penalty, with the exception of return costs. Any return or exchange request beyond this period will not be considered. It is specified that if the deadline expires on a Saturday, Sunday, public holiday or non-working day, it is extended until the next working day.

The right of withdrawal does not apply to any specific orders placed by the Client and manufactured for them, such as an order for a personalized product or one packaged in a particular way and available only upon specific request from the manufacturer or custom-made at the Client's request.

 

 To return the product(s), the Client shall return the product(s) to the following address:

Before any return, the Customer must contact the seller via the "Contact" section or by phone. The Seller will then send the Customer an email detailing the return procedures, including the return address and the recommended shipping method.

This right of withdrawal cannot be exercised if the delivered product is not in perfect condition, namely: unworn, unwashed, and as delivered by Fil de Légende in its original packaging, which includes:

- the packaging used for transport during delivery. As it is a fragile product, only the original packaging ensures safe transport and equivalent preservation conditions.

- with the exception of elements not essential to this packaging.

In the event of exercising the right of withdrawal, the Customer will be offered an exchange of the product or a refund of the sums paid. In the case of an exchange, return shipping costs will be borne by the customer, and shipping costs for the new product will be borne by the seller up to the initial delivery costs, and beyond that, by the Customer. If the Customer wishes to be reimbursed, this reimbursement will occur within 30 days by crediting the bank account used for the initial payment, excluding any other means, particularly cash.

Warranties

Warranty of Conformity

In accordance with articles L.211-4 to L211-14 of the Consumer Code, you benefit from the warranty of conformity of products.

The Product must be fit for the use usually expected of a similar product and correspond to the description made by Fil de Légende on its website. However, products presenting minor variations from the characteristics indicated on the site at the time of the conclusion of the Contract cannot be considered non-conforming.

After a period of 6 months from the delivery of the Product, the Customer must prove that the denounced non-conformity existed prior to delivery. Furthermore, after a period of 2 years from the delivery of the product, the Customer can no longer invoke the warranty of conformity.

You must inform us of your claims by email via the "contact" section on the Fil de Légende website. Non-conforming products will be exchanged, subject to availability, or refunded, which can only take place once the products have been reshipped and received by Fil de Légende. The Customer must attach the original sales invoice.

The refund or delivery of new products by Fil de Légende will occur within 30 days of receipt of the non-conforming products. The refund or delivery of new products will not incur any costs for you.

Warranty against hidden defects

The customer also benefits from a warranty against hidden defects as provided for in articles 1641 to 1649 of the Civil Code. This warranty only applies to defects that render the product unfit for its intended use. It does not apply to defects apparent upon delivery or to those of which the customer was aware. After a period of 2 years from the delivery of the product, the warranty against hidden defects can no longer be invoked.

Any claim concerning a hidden defect must be submitted to us by email via our contact form. In the event of a hidden defect, Fil de Légende will refund the price of the product. Return postage costs are borne by the seller.

Retention of Title

Fil de Légende expressly reserves ownership of the delivered products until full payment of their price.

The above provisions do not preclude the transfer of risks of loss or damage to you.

In the event of non-payment in full, Fil de Légende will be entitled to demand the return of the delivered products. Any costs incurred for this return will be at your expense.

Personal Data

The Customer is informed that the nominative information collected, notably through the online order form, is necessary for the processing and delivery of orders, the establishment of invoices, and the fight against payment fraud. This information is strictly confidential and intended solely for the company Fil de Légende. The Customer is informed that the order cannot be placed if this form is not correctly filled out. This form indicates whether the fields to be filled in are optional or mandatory.

The customer is informed that the company Fil de Légende uses data collection systems such as cookies. A cookie is a computer file stored on the hard drive of the Customer's computer. Cookies allow for signalling a previous visit by the Customer or Visitor to the site and linking it to personal data left on the site, particularly in the context of identifying the shopping cart.

In accordance with the provisions of the law of January 6, 1978, and CNIL declaration NS 48, your credit card numbers are stored in encrypted form for the duration of the order.

In accordance with Law No. 78-17 of January 6, 1978, relating to data processing, files, and freedoms, the processing of personal information collected on the website www.fil-de-legende.com has been declared to the CNIL under NS 48 with registration number 1622420. The user has a right to access, modify, rectify, and delete data concerning them.

Liability

The seller is responsible to the Customer for the proper execution of the order and is bound only by an obligation of means. Fil de Légende's liability cannot be engaged for any inconveniences or damages inherent to the use of the internet, including service interruptions, external intrusion, computer viruses, data loss, or events classified as force majeure. Similarly, Fil de Légende's liability cannot be engaged for unforeseen events, and without this list being exhaustive, such as strikes, fires, disasters, breakdowns, and generally any event preventing the proper execution of orders.

Fil de Légende's liability cannot be engaged, subject to legal provisions, in the event of an error in any of the photographs or texts illustrating the products. Fil de Légende also disclaims all responsibility for the improper use, misuse of products, and any event subsequent to the use of a product sold to the Customer, who alone assumes full responsibility for the use of the product they chose and purchased on the site.

In any event, and without limiting the preceding stipulations, Fil de Légende's liability will be limited to the amounts paid or payable at the time of the order giving rise to said liability, regardless of the cause or form of the action concerned.

Intellectual Property

The entirety of this site is protected by French and international intellectual property laws. All reproduction rights are reserved. All texts, graphics, logos, images, illustrations, graphic charter, animations, audio or video clips composing the pages of this site cannot, in accordance with the provisions of the intellectual property code, be subject to any representation or reproduction, in whole or in part, on any medium whatsoever, without the express prior authorization of Fil de Légende. The user undertakes not to copy all or part of the site onto another site or an internal company network. Any creation of a hyperlink from a website to the site www.fil-de-legende.com must be subject to express authorization from the company Fil de Légende. Upon simple request from the company Fil de Légende, this link must be removed.

Similarly, the brand and logo as well as the garments featured on this site are registered. Their total or partial reproduction is prohibited.

Entirety

In the event that one of the clauses of this contract is null and void due to a change in legislation, regulation, or a court decision, this shall not affect the validity and observance of these general terms and conditions of sale.

Duration

These conditions apply for the entire duration of the online availability of products and services offered by Fil de Légende and are subject to change. In the event of modifications, the general terms and conditions of sale applicable to an order placed by a Customer on the website www.fil-de-legende.com are those accepted by the Customer on the day the order is placed.

Applicable Law and Competent Jurisdiction

These general terms and conditions of sale are governed by French law. Disputes arising from the application of these general terms and conditions of sale are subject to French law, and only French courts can rule on them if an amicable solution has not been found.
